I was flying with Air Belgium to a non-EU/non-UK country. Can I still claim compensation?
Yes. Because Air Belgium' headquarters are in Belgium, the EU flight compensation laws apply to the airline. Even if you are flying with Air Belgium to South Africa or the Dominican Republic, you are entitled to compensation if your Air Belgium flight is delayed or cancelled.
However, if a non-EU/non-UK carrier would operate your flight, the situation can be different, as shown in the table below.
Type of flight | Example | Compensation |
---|---|---|
Flying with a British carrier | Tokyo to London with British Airways | Yes |
Flying with a EU carrier | Amsterdam to London with KLM | Yes |
Flying with a non-UK/non-EU carrier from the UK | London to Tokyo with Japan Airlines | Yes |
Flying with a non-UK/non-EU carrier to the UK | Tokyo to London with Japan Airlines | No |
Extraordinary circumstances — can Air Belgium deny me compensation?
When a third party or force majeure causes a delay or cancellation, Air Belgium has the right to refuse compensation. These situations are referred to as extraordinary circumstances.
Some of the most common extraordinary circumstances are:
Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).
However, a strike of the airline's crew is not considered an extraordinary circumstance!
Political circumstances, such as a terrorist attack or general security risk due to political unrest.
Natural disasters, including volcanic eruptions and hurricanes.
A collision between the aircraft and birds or other foreign objects.
An ill or unruly passenger.
Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.
You should be aware, however, that airlines sometimes claim that extraordinary circumstances occurred, even if that was not the case. This is a trick used by airlines to avoid having to pay flight compensation to passengers.
How to make the airline accountable in such a case? Claim Air Belgium compensation with Flight-Delayed.co.uk! We will thoroughly analyse all available information (e.g. aviation and weather data) and fight for your flight compensation!
How long do I have to claim my Air Belgium compensation and refund?
Air Belgium doesn’t depart from the UK, therefore the time limit to claim flight compensation will depend on different local rules:
The law in the country of departure
The law in the country of arriva
The law in the country where the airline is headquartered
In general, when flying with Air Belgium, you have only 1 year to submit a claim, as this is the law in Belgium. However, if your flight is going to — for example — a French island, such as Guadeloupe, you can claim based on the French law which gives passengers 5 years to submit a claim.
